Srijato Bandopadhyay's poem, that refers to putting condom on a Trishul, which is one of the most important symbols of the Hindu religion, is defamatory and hurts the religious sentiments according to petitioner, as found by the court. The court also witnessed that the police has not been filing a report on the matter which shows they are siding with the respondent.

The case has been recently transferred to Detective department, Kolkata. The court directed that a report on the matter should be submitted by the DCP and must be vetted by Commissioner of Police, Kolkata.

The state asked for time to file a report to which the court directed, "This Court directs that a comprehensive report be submitted by the Deputy Commissioner of Police duly vetted by the Commissioner of Police, Kolkata Police on the adjourned date. Let this matter stand adjourned and be listed on 17th November, 2022 under the same heading".
